An injunction is another way of saying a restraining order, and it means that someone is alleging that you have committed an act of violence against them. There are several types of injunctions. There is an injunction for protection against domestic violence, against repeat violence, against dating violence, and against sexual violence.
An injunction for protection against domestic violence means that a person is alleging that a household or family member has committed an act of violence.
Types of Injunctions for Protection in Florida
Florida law recognizes several types of protective injunctions, depending on the parties’ relationship and the nature of the alleged conduct.
An injunction for protection against dating violence applies when a person alleges that someone with whom they have had a romantic or intimate relationship committed an act of violence.
An injunction for protection against repeat violence applies when a person alleges that another individual committed at least two separate acts of violence. In these cases, the most recent act must have occurred within the past six months.
An injunction for protection against sexual violence applies when a person alleges that another individual committed an act of sexual violence, regardless of the nature of their relationship.
What Qualifies as Violence
Under Florida law, the definition of violence is broad. It may include, but is not limited to, acts such as battery, assault, stalking, or kidnapping.
